Dr Bahr meets with the Dr. Katz and Ms. Barker to review the case. They discover that Dr. Kutter, has disregarded the AV's request to stop the unapproved procedure.

Dr Katz explains that he met with Dr. Kutter after he finished the procedure and revived the animal, he met with Dr. Katz.  He goes on to explain that Kutter said:

"The method they were using wasn't working to their satisfaction and they needed to make a modification to stay on schedule with their obligations to the sponsors, Northeast Medical Equipment Inc. (NMEI)"

Kutter went on to explain:

"I needed to get preliminary data for a talk in 10 days, at a Company sponsored symposium in Aspen, Colorado.

When the AV asked why he didn't submit an amendment to the protocol, Kutter answered:

" I just didn't have the time because I was extremely busy with my sick patients, my departmental teaching responsibilities, my IRB committee obligations and that I had to go to my daughters "Parents Weekend" festivities at her college sorority in North Carolina."

With the next full meeting of the IACUC 3 weeks away, what, if anything, should Dr. Bahr do now?

  4. Write a letter to OLAW and USDA
